Unfair competition usually is a tort action that has triggered financial hurt to a business through misleading or wrongful practices. The term is often broken down into two categories: (1) torts that confuse consumers as to the source of a product and (2) unfair trade practices. We practice in both categories. Types of unfair competition include: false representation of products or services, trademark infringement, one brand of goods substituted for another without authorization, use of confidential information by former employee to solicit customers, theft of trade secrets, a breach of restrictive covenant, trade libel and false advertising.
We have experience with:
- Antitrust
- Breach of Fiduciary Duty/Consumer Fraud
- RICO Violations
- Trade Secrets
- False Advertising
